In a pending suit between the plaintiff/first petitioner and the defendant/private respondent, learned trial Court directed the parties to maintain status quo in respect of the property as on date with regard to its nature, character and existing possession. The plaintiff/first petitioner filed an application under Section 151 of the Code of Civil Procedure for implementation of the said order on an allegation that defendant/private respondent was trying to dispossess him from the property and was attempting to obstruct his pathway. Learned trial Court directed the police authority to provide assistance to the plaintiff/first petitioner as and when sought for implementation of the order of status quo. The petitioner lodged a complaint before the police authority which was diarised by the police as appears from the report.
Report submitted by the State prima facie demonstrates that there is no obstruction to the
petitioners' access to the brick field as alleged by the petitioners.
Be that as it may, since an order of status quo has been granted by the learned trial Court, the police authority is directed to monitor strict compliance of the said order and also to keep strict vigil over the area so that there is no breach of peace and tranquility. The writ petition be accordingly disposed of. There shall be no order as to costs.
Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
