11.11.2024 rc/ct.no.34 Item No.25 CRR No. 4134 of 2024 In the matter of : M/s Eastern Tyre Service .......Petitioner Mr.Avijit Ghosal ...for the Petitioner Since the petitioner seeks expeditious disposal of the case being CS/3834 of 2023 pending before the learned Metropolitan Magistrate, 9th Court, Calcutta presently redesignated as the learned Judicial Magistrate, 9th Court, Calcutta the matter may be disposed of without service of notice upon the opposite parties. The opposite parties shall not be prejudiced by an order directing expeditious disposal of the matter.

Learned counsel for the petitioner submits that despite several orders passed by the learned Trial Court, the accused have failed to appear before the learned Trial Court on several occasions, resulting in delay in the case. Learned counsel submits that despite specific direction of the learned Trial Court upon the accused/ opposite parties to appear before the Court, the said order has not been complied with.

Upon consideration of the submission made on behalf of the petitioner, this Court directs the learned Trial Court to take necessary steps for securing the attendance of the accused/ opposite parties before him and conclude trial as expeditiously as

possible without granting any unnecessary adjournment to either party, in accordance with law.

CRR No. 4134 of 2024 is disposed of accordingly. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
