Report submitted by the State is taken on record. Heard learned counsels for the parties.

It is not in dispute that the present complaint pertaining to Cyber Crime PS Case No.48 of 2025 dated 8th September, 2025 is identical to an earlier complaint lodged by the petitioner against the private respondent being Thakurpukur PS Case No.263 of 2025. Report submitted by the State also confirms the same.

In view of the above, let investigation of both the complaints be taken up together by Thakurpukur Police Station and be taken to a logical conclusion in accordance with law.

Since both the complaints are identical, the second complaint be treated as statement of the complainant under Section 180 of the BNSS and investigation be proceeded with accordingly.

The investigating officer of Cyber Crime Police Station, Murshidabad shall hand over the case diary along with all relevant material to the investigating officer of Thakurpukur PS at the earliest.

The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
