In Re: An application under Section 401 read with Section 482 of the Code of Criminal Procedure.

The revisional application was preferred challenging the proceeding being Complaint Case No. C-108 of 2011 under Sections 406/418/420of the Indian Penal Code and pending before the Learned Judicial Magistrate, 7th Court, Alipore. The revisional application was preferred at a stage when the Learned Court after taking cognizance of the offences, issued process and the accused person (being the present petitioner) through their learned advocate preferred application under Section 205 of the Code of Criminal Procedure for dispensing their personal appearance in Court from day to day proceedings.

Records of the revisional application reflect that although the same was filed 9 years ago but the revisional

application has not been admitted. Nobody attempted to get the revisional admitted. Further, the issues advanced in the revisional application are all question of facts which are to be adjudicated in course of the trial and cannot be interfered by this Court at this stage.

Accordingly, CRR 3166 of 2012 is dismissed.

Pending application, if any, is disposed of.
