Heard the learned counsel for the petitioner as well as the learned State counsel.

The learned counsel for the writ petitioner submits that the writ petitioner was appointed as a Constable in the West Bengal Police on 18.04.2022 against a vacancy existing in Basirhat Police District. He was sent to the Police Training School, Salua at Paschim Medinipur for undergoing basic training. Thereafter, it was detected that he was suffering with 'Amblyopia' in the right eye. After being subjected a medical examination by a Board on 05.04.2023, the petitioner was discharged from service by an order dated 01.05.2023.

The learned A.G.P., upon instructions, submits that without availing remedy of appeal before the Assistant Inspector General of Police (Administration), the petitioner has directly rushed to the West Bengal Administrative Tribunal.

Being faced with such objection, the learned counsel for the writ petitioner submits that he may be allowed liberty to avail the remedy of appeal.

With such liberty, we dispose of the writ petition. 6.

We make it clear that we have not made any expression on the merits of the matter.

There will be no order as to costs.
