Mr. Nirmal Ray ..For the Petitioner Mr. Pannalal Bandopadhyay ...For the State The petitioner claims to be working in the post of Civic Defence Volunteer since October 8, 2021. After his engagement, a Scheme for training of the community volunteers was introduced by the Government of West Bengal under the Aapda Mitra Scheme by a Memorandum dated June 2, 2022.

Mr. Ray, learned advocate appearing on behalf of the petitioner submits that the petitioner made a representation on August 3, 2022 for being considered to be a fit candidate for training, but he was neither called for training nor interview. The list of candidates who were considered eligible for training did not contain his name. He refers to the lists dated July 18, 2022 and July 29, 2022 issued by the District Disaster Management office, Murshidabad.

Mr. Bandopahdyay, learned counsel appearing on behalf of the respondent submits that there was no representation to be considered for training under the Aapda Mitra Scheme made by the petitioner. The petitioner only wanted to be engaged as a regular employee by the representation dated August 3, 2022.

The training that now the writ petitioner wants to be considered for was completed on October 22, 2022. Therefore, the case of the petitioner cannot be considered now. In the event, any further training programme is organized by the District Management office, Murshidabad, the petitioner may make necessary application for being considered to participate in such training programme.

Having considered the rival submissions of the parties and the materials placed on record, this Court finds that since the training programme that was organized by the office circular dated July 29, 2022 by the District Management office, Murshidabad from August 25, 2022 till October 22, 2022 is already over, the petitioner cannot be considered for the same. In case, there is a subsequent training programme under the Aapda Mitra Scheme introduced vide Notification dated June 2, 2022, the petitioner may make necessary representation for

participation in the same to the Controller of Civic Defence, Murshidabad/respondent no. 3.

With the directions aforesaid, W.P.A. 23472 of 2022 is disposed of.
