This is an application for a direction for expeditious hearing and disposal of a case under Section 20(b)(ii)(c)/27A/29 of the N.D.P.S. Act being Case No. N 89/2021 pending before the learned Special Judge (N.D.P.S. Act) at Barrackpore. On perusal of the petition and having heard the learned Advocate for the petitioner, this Court is of the view that the instant revision can be disposed of here and now with the assistance of the learned Public Prosecutor-in-Charge. Therefore, Mr. Arijit Ganguly, learned Public Prosecutor-in-Charge is requested to attend this Court. The learned Advocate for the petitioner is requested to hand over a copy of the application to Mr. Ganguli.

Mr. Ganguly has received the copy of the application under Section 482 of the Code of Criminal Procedure. Appointment of Mr. Ganguly be regularized by the learned Legal Remembrancer, Government of West Bengal.

It is submitted by the learned Advocate for the petitioner that the petitioner was arrested on 7th October, 2021 and since then he is in judicial custody. Upon filing of the charge-sheet in the aforesaid case, the Trial Court framed charge against the petitioner on 16th August, 2022. Subsequently dates were fixed for evidence but till date out of 10 charge-sheeted witnesses only one witness was examined in part. The next date of hearing is fixed on 2nd February, 2023.

Considering the period of detention of the accused the learned Trial Judge is requested to take expeditious step for disposal of the above-mentioned case within eight months from the date of receipt of the copy of this order.

The petitioner is at liberty to communicate the server copy of the order to the Court below.

The instant revision is, thus, disposed of.
