Kausik (Rejected) CRM (M) 1834 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/ Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Bhimpur Police Station Case No. 384 of 2023 dated 11.10.2023 under section 341/325/307/302 of the Indian Penal Code. Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than two years and till date there has been no substantial progress in the case. Additionally it has been submitted only 3 witnesses out of the proposed 18 witnesses have been examined and last of the witnesses was examined on November, 2024.

Learned advocate for the State submits that the next date is fixed on 19.11.2025.

Having regard to the fact that 16 more witnesses are yet to be examined and there has been no persuasion on behalf of the prosecution, I direct the Superintendent of Police, Nadia, Krishnanagar to engage a Nodal Officer who would monitor the day to day progress of the trial of the case. The said Nodal Officer must be a Officer in the rank of Additional SP/DSP.

It is further stated that the Nodal Officer would especially take care regarding the availability of the witnesses on the date so fixed by the learned Trial Court. At this stage, prosecution is granted opportunity so that, at least 12 witnesses must be completed by 28.11.2026. Learned Trial Court is directed to continue with the trial of the case in spite of any resolution of the local bar. However, no unnecessary adjournment be granted to any of the parties. In case there are violations, petitioner would be at liberty to renew his prayer for bail.

At this stage, CRM (M) 1834 of 2025 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
