Same issue came up for consideration earlier before this Bench in FMA 1368 of 2024 (United India Insurance Company Limited vs. Tufani Ram @ Chaudhury & Ors.) decided on 24th April, 2025 in which we have negated the submission made on behalf of the Insurance Company. Similar issue as raised here had been decided in the said appeal. We did not admit the said appeal.

2. In view of the above, the appeal and the application stand dismissed.
