In view of the order proposed to be passed in the present application under Article 227 of the Constitution of India, service of notice of the present application upon the opposite parties is not necessary.

The grievance of the plaintiffs, the petitioners herein is that in spite of the direction of the coordinate Bench of this Court passed on March 19, 2024 in C.O. 310 of 2024, the pending applications in Title Suit No. 1461 of 2023 have not yet been disposed of.

Mr. Nag, learned advocate for the petitioners submits that pursuant to the said direction, only the application for addition of party has been disposed of but other applications have not.

This Court is informed that November 14, 2024 is the next date is fixed for hearing of the rest two applications; therefore, it is desired that the 2nd Court of learned Civil Judge (Senior Division)

at Alipore, District: 24-Parganas (South) where the said suit is pending, adhering to the abovementioned direction of the co-ordinate bench, shall make all endeavour to dispose of the rest two pending applications as expeditiously as possible in accordance with law, and in doing so, shall not grant any unnecessary adjournment to either of the parties.

C.O. 3446 of 2024 is disposed of with the above terms without any order as to costs.
