Petitioner is in custody for 135 days. Co-accused has been granted pre-arrest bail. Accordingly, he prays for bail.

Learned Advocate for the State opposes the bail prayer.

We have considered the statements of witnesses recorded under Section 164 of the Code of Criminal Procedure. Petitioner is named as the assailant in the statements. He does not stand on the same footing with co-accused viz., Shilpa Bauldas who has been granted anticipatory bail.

In view of the aforesaid materials against the petitioner and gravity of offence, we are not inclined to grant bail to the petitioner at this stage.

Accordingly, the prayer for bail of the petitioner is rejected.
