None appears for the private respondents despite service.

Heard learned counsels for the parties.

The petitioners allege that the private respondents have raised construction on PWD land adjoining the petitioners' land thereby obstructing their egress and ingress.

The petitioners filed an application before the SubDivisional Executive Magistrate, Lalbagh and on perusal of the police report submitted therein, the learned Executive Magistrate directed the private respondents to remove the construction within a stipulated time frame. The construction has not been removed as yet.

Learned counsel for the State submits that the private respondents have constructed their residential unit on PWD land by blocking the petitioners' egress and

ingress. The police requested both the parties to maintain peace in the locality till disposal of the case. Learned counsel for the petitioners seeks to take necessary steps before the appropriate forum for redressal of their grievance. Such liberty is granted. The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
