Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner's husband purchased the property in question in the building. Soon thereafter, he became friendly with a lady neighbour. Now in collusion with her, the husband is disturbing and even torturing the petitioner. Learned counsel appearing on behalf of the State submits that earlier on the complaint of the petitioner, cases had been started, one under Section 498A of the Penal Code. The police are keeping a close watch on the developments in the locality.

If the petitioner is of the view that the allegations levelled by her, make out a cognizable case, it shall be open to the petitioner to act in terms of the ratio laid down in Aleque Padamsee's Case, (2007) 6 SCC 171.

Therefore, no further order need be passed in this case. However, the police authorities shall keep a sharp vigil at the locale and ensure that no breach of peace takes place. With these observations, the writ petition is disposed of. Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for. (Jay Sengupta, J.)
