In view of the above, this Court is inclined to hold that allowing the proceedings to continue shall be a futile exercise.

Accordingly, CRR No. 3797 of 2023 and CRR No. 3772 of 2023 are allowed.

Proceedings being Complaint Case No. CNS/9445 of 2023 pending before the learned Metropolitan Magistrate, Calcutta presently re-designated as 19th Judicial Magistrate, Calcutta be quashed.

The connected applications being CRAN No. 1 of 2024 and CRAN No. 2 of 2024 in CRR No. 3797 of 2023 as also CRAN No. 1 of 2024 and CRAN No. 2 of 2024 in CRR No. 3772 of 2023 are disposed of.
