The learned advocate for the petitioners as well as the private opposite party No. 1 is present.

None appears on behalf of the State.

The learned advocate appearing for the petitioners submitted that out of the cited 10 charge-sheeted witnesses already 5 witness have been examined by the prosecution. However, still 5 witnesses are yet to be examined. According to the petitioners, the case was instituted in the year 2018 and there is an aged person that is petitioner No.2 i.e. Saroj Kumar Ghosh who is about 93 years old. Having considered the plight of the petitioners, I direct that the learned trial court on and from 15th January, 2024 (the next date schedule so fixed) would take steps so that on each and every month a scheduled consisting of three dates are fixed and the trial is taken to its logical conclusion as expeditiously as possible. If the witnesses who are from the police department or any other Government Department are reluctant to appear, the learned trial court would be at liberty to seek assistance of senior officer of

police preferably from the Barrackpore Police Commissionerate. The said superior Officer in the rank of D.C. would take steps to ensure regarding the availability of the witness on the date so fixed by the learned trial court.

The public prosecutor would ensure regarding the production on materials, documents and exhibits on the date so fixed for the examination of a particular witness. All the stakeholders should take steps for concluding the trial at the earliest. With the aforesaid observations, the present revisional application being CRR 3790 of 2023 is disposed of. Pending applications, if any, are consequently disposed of. Certified copy of the order be kept on record. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
