Ms. Debjani Ghoshal ...for the Petitioner A684 18-12-2025 AKG Ct. 15 The petitioner claims ownership of 7 kathas of land comprised in R.S. Dag No. 893, J.L. No. 5, Mouza-Naldanga, Chinsurah, Hooghly.

It is the grievance of the petitioner that an adjacent Gurudwara, popularly known as "Gurudwara Balikata," has undertaken unauthorised construction of a bathroom without leaving the mandatory setback space. It is further alleged that waste water from the said bathroom is likely to flow onto the petitioner's land through the pipelines connected thereto. The petitioner apprehends that his land would suffer substantial damage on account of such discharge of waste water from the Gurudwara.

The petitioner seeks removal of the said pipeline so that no nuisance is caused to his landed property. Learned counsel appearing on behalf of the petitioner submits that a representation in this regard was made to the Pradhan, Debanandapur Gram Panchayat, as appearing at page 20 of the writ petition; however, no response has been received to the said representation.

Let the affidavit of service filed by the petitioner be retained on record. None appears on behalf of the respondents.

In view of the aforesaid, the writ petition is disposed of with a direction upon the Pradhan, Debanandapur Gram Panchayat, to convene a meeting of all concerned parties and to take necessary steps in accordance with law to ensure that no nuisance is caused to the petitioner's landed property due to the flow of waste water from the bathroom of the Gurudwara.

The said exercise shall be completed within a period of one month from the date of communication of this order. Accordingly, WPA 24139 of 2024 stands disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
