Kausik (Allowed) CRM (M) 2199 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Under Section 439 of the Code of Criminal Procedure, 1973 in connection with Gurap Police Station Case No. 212 of 2022 dated 4th November, 2022 under sections 120B/302/201/34 of the Indian Penal Code. Learned advocate appearing for the petitioner submits that the present petitioner is in custody for more than 3 years and the evidence of the witnesses who have been examined do not inspire confidence to establish the offence at the conclusion of the trial. Additionally, there is no scope of the trial being concluded in near further.

On the other hand, learned advocate for the State opposes the prayer for bail. Learned advocate for the State submits that 11 witnesses have already been examined and the State proposes to examine 6 more witnesses.

I have considered the materials in the case diary as well as the deposition of the witnesses. Having considered the period of detention of the present petitioner and his complicity,

I am of the view that further detention of the petitioner is unwarranted.

As such petitioner shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of like amount each. One of whom must be local to the satisfaction of the learned CJM, Hooghly at Chinsurah.

If on bail, the petitioner shall be physically present before the Trial Court on each and every date. Petitioner shall not leave the jurisdiction of Chinsurah Police Station without the leave of the learned Trial Court.

Accordingly CRM(M) 2199 of 2025 is allowed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
