that the petitioner is in custody 6 years 9 months and out of 13 witnesses proposed to be examined by the prosecution, only 8 witnesses have been examined.

Learned advocate for the State has produced the case diary as also the statement of the mother of the victim girl. Be that as it may, prosecution is granted time to conclude its witnesses by 15th January, 2026. If the evidence of the prosecution is not complete within the aforesaid period, learned special court would release the petitioner on bail on such terms and conditions as the learned special court/trial court deems fit and proper.

Accordingly, CRM (M) 2134 of 2025 is disposed of with the aforesaid directions.

Report submitted by the State be kept with the record. Case diary be returned to the learned advocate appearing for the State.
