Report has been filed on behalf of the state. Petitioner is aggrieved by the manner in which the investigation of Kandi Police Station Case No. 280/24 dated 13.06.2024 is progressing. A case was registered under section 363/365 by the said police station.

The subject matter of the case relates to the father of the present petitioner being not traceable with accusations. Some steps have been taken by the investigating officer of the case but which fall short of efforts to trace out the person concerned, in respect of whom the FIR has been registered and the plight of the petitioner for finding his father.

I have considered the report submitted by the state and having perused the same I am of the

view that the local police station lacks infrastructure to exhaust the remedies. Accordingly, I direct that Kandi Police Station Case No.

280/24 dated 13.06.2024 be transferred to CID, West Bengal. A.D.J. CID West Bengal would depute an appropriate officer to his choice who would take efforts in respect of the accusations and/or allegations made by the petitioner.

Report be submitted before the jurisdictional magistrate within a month regarding the progress of the investigation of the case by the new investigating officer.

With the aforesaid observations WPA 24404 of 2024 is disposed of.
