Mr. Robiul Islam Mr. Sahmim ul Bari Mr. Marooq Rahman Ms. Jhilik Singha ..for the petitioners Mr. Rudra Jyoti Bhattacharjee Ms. Sanchayita Das ..for the Union of India Mr. Ayan Banerjee Ms. Sharmila Deb ..for the State The petitioners have challenged the arbitral award passed under sub-sections 6 and 8 of Section 20F of the Railways Act, 1989 as amended with retrospective effect from January 31, 2008. Sub-section 7 of Section 20F states that the provisions of Arbitration and Conciliation Act, 1996 shall apply to every arbitration under the Railways Act.

Since the provisions of the Arbitration and Conciliation Act, 1996 shall apply to the arbitral award which is under challenge in this writ petition, this Court is not inclined to entertain this writ petition. Faced with such situation, the learned advocate appearing for the petitioners prays for leave to withdraw this writ petition with liberty to take appropriate steps in accordance with law.

In the light of the submissions made by the learned advocate for the petitioners, WPA 23889 of 2025 stands dismissed as withdrawn with liberty to the petitioners to take appropriate steps in accordance with law. (Hiranmay Bhattacharyya, J.)
