Learned advocate appearing for the petitioner submits that petitioner is in custody for 5 months 15 days. It has also been contended that the petitioner is the husband of the victim/deceased who is similarly situated as other accused persons who have been released on bail.

Learned advocate for the State has produced the case diary and drawn the attention of the Court to the statement of the witnesses including the statements recorded under section 183 of the BNSS.

Having considered the period of detention of the present petitioner and his complicity, prima facie I am of the view that further retention of the petitioner is unwarranted. Accordingly, the petitioner be released on bail.

Petitioner shall furnish bond of Rs. 20,000/- (Twenty Thousand Only) with two sureties of Rs. 10,000/- (Ten Thousand Only) each. One of whom must be local to the satisfaction of the learned ACJM, Kakdwip.

If on bail, the petitioner shall meet with the Inspectorin-Charge/Officer-in-Charge of Namkhana Police Station once in a week till the charge is framed by the Trial Court. Accordingly, CRM(M) 2133 of 2025 is allowed.

Case diary be returned to the learned advocate appearing on behalf of the State.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
