Learned advocate for the petitioner submits that the petitioner is in custody for more than 7 months and has been implicated in the case for reasons best known to him. It has also been contended that the victim died because of electrocution and the petitioner has been implicated in the murder case. Learned advocate for the State opposes the prayer for bail and submits that intentionally and purposely the accused had installed a boundary wall wherein there were electrical connections which resulted in the death of the victim.

I have taken into account the overall materials appearing in the case diary and the period of detention of the petitioner and I am of the view on an overall assessment that further incarceration of the petitioner is unwarranted.

Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Mukhlesh @ Muklesur shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned ACJM, Chanchal, Malda. If on bail, the petitioner shall be physically present on each and every date fixed by the learned trial court in seisin of the case and shall not leave the jurisdiction of the district of Malda without the prior permission of the learned trial court. Accordingly, CRM(M) 2175 of 2025 is allowed.
