The petitioners were licensees of a foreign liquor off-shop. The license stood suspended by the order of the Additional District Magistrate (General) and Collector of Excise, Birbhum as no competent person was found to run the shop by maintaining the rules. The suspension was to remain valid till the disposal of the misc. case.

It has been submitted that the misc. case is pending consideration since 2018. The petitioner applied before the Additional District Magistrate (General) and Collector of Excise, Birbhum in September 2022 praying for early disposal of the misc. case. Neither the misc. case nor the representation filed on behalf of the petitioners has been disposed. 3.

In view of the above, the instant writ petition is disposed of by directing the Additional District Magistrate (General) and Collector of Excise, Birbhum to take steps in accordance with law for disposal of the misc. case that is pending at the earliest but positively within a period of eight weeks from the date of

communication of this order. A reasonable opportunity of hearing shall be given to all the necessary parties. A reasoned order shall be passed and communicated to all the parties immediately thereafter.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
