Mr. Ray, learned advocate appearing for the petitioners submits that during the pendency of the revisional application the trial of the case has commenced before the jurisdictional Court. As none appears on behalf of the State, Ms. Faria Hossain along with Ms. Baisali Basu, learned advocates who ordinarily appears for the State, are directed to appear in this matter and represent the State. Their appointment may be regularized by the concerned authority.

In view of the stage of the trial, which has progressed during the pendency of the revisional application, I am of the opinion that the petitioners would be at liberty to take up the points canvassed in this revisional application at the appropriate stage of cross-examination and during the final arguments of the case before the Learned Trial Court.

With the aforesaid observations, CRR 3877 of 2009 is disposed of All pending connected applications, if any, are consequently disposed of.
