1. The matter has been listed under the caption 'To Be Mentioned'. It is submitted by the learned advocate for the petitioner that the direction has been issued to the 4th respondent, whereas the appropriate authority to take action is the Assistant Engineer, Diamond Harbour Highways Sub-Division, P.W. (Road) Directorate, Puratan Bazar, P.W.D. Joynagar Sub-Division, P.O-Diamond Harbour, District - South 24-Parganas.

2. Accordingly, in paragraph 2 of the order dated 3rd October, 2023 instead of the direction to the 4th respondent, there will be a direction to the Assistant Engineer, Diamond Harbour Highways Sub-Division, P.W. (Road) Directorate, Puratan Bazar, P.W.D. Joynagar Sub-Division, P.O-Diamond Harbour, District -South 24-Parganas, as noted above, who shall take action on the basis of the complaint given

by the petitioner. Consequently, I.A. No. CAN 1 of 2023 is disposed of.

3. Necessary correction be made in the said order and this order shall form part of the order dated 3rd October, 2023.

4. Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
