In Re : An application under Section 401 of the Code of Criminal Procedure, 1973;

In the matter of : Sanjay Prasad ...petitioner. The present revisional application has been preferred against the order dated 12.06.2012 passed by the learned Judicial Magistrate, 2nd Court, Barrackpore, North-24 Parganas in Case No.M-473 of 2020 under Section 125 of the Code of Criminal Procedure.

The subject matter of the impugned order relates to interim maintenance of Rs.2,500/- per month being awarded to the wife and Rs.1500/- per month to the minor daughter. Having regard to the quantum of maintenance so awarded and the cost of living involved for an individual to sustain as also the fact that the said order was passed by way of an interim measure during the pendency of the final disposal of the proceedings, I am of the considered view that no interference is called for.

Accordingly, CRR 3177 of 2012 is dismissed.

Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
