The revisional application was preferred in respect of a proceeding being M.P. Case No.316 of 2012 wherein the learned Sub-Divisional Magistrate, Tamluk by an order dated 01.08.2012 was pleased to pass a restraint order regarding the usage of water from the water body till 29.08.2012.
The proceedings were under Section 144(2) of the Code of Criminal Procedure.
Having regard to the time constraints incorporated in the said provisions, I am of the opinion that the main proceedings before the Executive Magistrate have become infructuous. Accordingly, CRR 3183 of 2012 is dismissed.
Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
