Galib, Mr. Kapil Guha ..for the State In this public interest petition the allegation of the petitioner is that during the Durga Puja Carnival at Durgapur on 7th October, 2022 the respondent no.8 by his ill motive had purchased unsold idol from local Kumartuli and by decorating the table had participated in the Carnival from Ward No.23.

Learned counsel for the State has filed the report disclosing that no award was given to the idol of Ward No.23 Puja Committee.

Even otherwise the issue which the petitioner is raising needs factual enquiry which cannot be conducted in this public interest petition.

Record reflects that the petitioner has already filed a complaint in this regard before the District Magistrate, Paschim Burdwan on 10th October, 2022. The said complaint can be duly considered in accordance with law by the concerned District Magistrate expeditiously.

The petition is, accordingly, disposed of.

Since no affidavits have been called for, therefore, we make it clear that we have not expressed any opinion in the merits on this factual issue.
