Mantu Adhikary v. State Of West Bengal And ORS.
11.01.2023 Court No.13 Item No.34 AP WPA 23482 of 2022 Mantu Adhikary Vs.
The State of West Bengal and Ors.
Mr. Golam Mohammad ... For the Petitioner.
Mr. Debajyoti Deb Ms. Somdyuti Parekh ... For the Respondent Nos.9, 10 & 11.
The petitioner claims that the private respondents, after having wrongfully evicted them from the premises, have detained certain articles and are refusing to return the same.
Counsel for the private respondents submits that the petitioner was permitted to store articles for a period of four days sometime in the year 2008. The petitioner is thereafter stated to have taken away his articles and left. The petitioner was never a tenant in this property. This Court is of the view that the disputes between the petitioner and the private respondents are civil in nature and cannot be entertained by the police and much less the writ Court.
Reserving the liberty to the petitioner to approach an appropriate Civil Court, the writ petition shall stand disposed of.
There shall be no order as to costs.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
