Report filed by the State is taken on record. Learned advocate for the petitioners submits that the petitioners are the members of a tribal community in Uttar Dinajpur. They have been living in those lands since ancient times. In violation on relevant laws, attempts are being made to transfer the property in the area and the henchmen belonging to the conspirators are harassing, intimidating and even assaulting the members of the said tribal community. Several complaints have been lodged against the private respondents, but no effective steps have been taken by the police. Learned advocate for the State relies on the report and submits that on the complaints of the petitioners, several FIRs have been lodged and the same are being investigated into. The matter relates to transfer of a tea garden. The police authorities are also trying to mitigate the flare up at the local level by employing different measures including different meetings between the

parties. In some cases, the private respondents have also reacted by using weapons. The police are keeping a close watch on the developments in the locality.

It appears that the police have already acted on the complaints made by the petitioners.

Let the FIRs registered be taken to their logical conclusion at the earliest and in accordance with law. Even otherwise, the police shall keep a sharp vigil at the locale and ensure that no breach of peace takes place. Surveillance shall include frequent visits by police patrol. The police shall also explore the possibility of posting armed police picket at conspicuous places. With these observations, the writ petition is disposed of.

Urgent certified copies of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
