1. The present application has been filed for restoration of C.O. 3465 of 2023 which was dismissed in default on 24th January, 2024.

2. Learned counsel submits that on the day fixed the petitioner was not represented on account of personal ground of the advocate. Learned counsel submits that the application has been moved within the period of limitation and, therefore, the petition may be restored.

3. Learned counsel for the respondent has opposed the restoration application. Learned counsel submits that even prior to 24th January, 2024, the petitioner had taken adjournment twice.

4. The Court has considered the submissions. In view of the personal grounds as being taken by the petitioner, the petition is restored to its original file and number subject to the cost of Rs.500/- to be deposited with the Calcutta High Court Legal Services Committee.

5. CAN 1 of 2024 stands disposed of.
