Nos.6 to 10 Affidavit of service filed in Court is taken on record. Report filed by the State is also taken on record. Learned advocate for the petitioners submits as follows. The petitioners are the owners of the land in question. The State acquired a portion of the land for construction of roads, but another portion of the land is now being grabbed by the private respondents.
Complaints were made before the police authorities, but no steps were taken. The private respondents are blocking the ingress and egress of the property. Learned advocate for the private respondents denies the allegations made in the writ petition and submits that the private respondents are also co-sharers in the said land. This is purely a civil dispute. However, the private respondents have not blocked the ingress and egress to the property.
Learned advocate for the State relies on the report and submits as follows. The private respondents are cosharers in the property. The BL&LRO had been asked to provide details of their respective shares. One person was arrested on a complaint made by the petitioners. The police are keeping a close watch on the developments in the locality.
It appears that there exists a civil dispute between the parties.
If any of the parties wants to establish any further right in respect of the property, the same has to be done before a civil court.
However, the police shall keep a sharp vigil at the locale, ensure that no breach of peace takes place and to see that no order of a civil court is violated. With these observations, the writ petition is disposed of.
Urgent certified copies of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
