2025-08-04Hon'Ble Justice Sujoy Paul,Hon'Ble Justice Smita Das De3 pages

4th August, 2025 In the High Court at Calcutta Item no. ML 51 Court No. 08 Asraf, A.R.(Ct.) Constitutional Writ Jurisdiction Appellate Side Case No.

WPA(P) 535 of 2022 In the matter of :

PRIYANKA DUBEY TIWARI .... Petitioner VS.

THE STATE OF WEST BENGAL & ORS.

....Respondents For the Petitioner :

Mr. Arindam Chattopadhyay Mr. Soumik Dey Ms. Rika Das ....Advocates For the Respondents / State :

Mr. Jahar Lal De, Addl. Govt. Pleader Mr. Shamim-ul-Bari ....Advocates 1.

In this Public Interest Litigation, the petitioner has himself pleaded in Paragraph 3 of the writ petition that petitioner is a social worker and has a good relation with the teaching and non-teaching staffs of Hazinagar Adarsh Hindi Vidyalaya.

More particularly, father-in-law of petitioner was assistant teacher of the said school and uncle-inlaw is the in-charge of morning session of the school. However, petitioner's father-in-law is no more.

2.

In order to substantiate the allegations, the petitioner has placed reliance on a communication dated 05.04.2021 being Annexure P-2 wherein one Shambhu Kumar Yadav has expressed certain displeasures in relation to functioning of the midday meal programme. However, a careful reading

of this representation does not throw any light about any allegation of misappropriation.

3.

Another representation is dated 12th April, 2021 being Annexure P-3 herein whereby one Priyanka Dubey (Tiwari) preferred a representation regarding allegations of improper distribution of mid-day meal and misconduct, misdeed, corruptions and defalcation etc.

This representation shows that against President certain criminal cases are instituted which is evident from perusal of paragraph 6 of this complaint.

4.

As noticed above, the petitioner and his family members have deep interest in the functioning of the school and his relatives are deeply associated with the school. Thus, it appears that petitioner is projecting the grievance against certain individuals by way of this Public Interest Litigation. We are not inclined to entertain this writ petition for this reason alone.

5.

Apart from this, the communications being Annexure P-2 and P-3 were submitted by other persons and petitioner appears to be canvassing their grievance through this PIL. Thus, we are not inclined to invoke our discretionary jurisdiction under Article 226 of the Constitution of India.

6.

This public interest litigation is accordingly dismissed.

7.
