Mr. Saha, ld. advocate for the petitioner, submits that the next date has been fixed by the ld. trial court in the month of February, 2024. The report which has been furnished before this court be also placed before the ld. trial court to ascertain as to whether the accused was informed that he was directed by the High Court to stay outside the jurisdiction. It reflects from the report that the accused is staying near a petrol pump at P.O. Hamadama within the jurisdiction of P.S. Deganga. The same is in violation of this court's order.
However, none represented the accused before this Court. At this stage, I am not inclined to cancel the bail ex
parte but the ld. trial court would issue notice to the inspector in charge Deganga p.s. who would ensure regarding the appearance of the accused before ld, trial court and the ld. trial court would ensure that the accused namely, Mizanur Rahaman, S/o. Sk. Mosaraf Hussain is staying outside the jurisdiction. The inspector in charge of Deganga P.S. is directed that he would depute an officer to trace out the accused and also inform the order of this court. In case, there is any violation of the order, in that case, the accused must be informed that the ld. Magistrate on the next date would cancel his bail when the date is fixed.
The accused/o.p. would inform the place where he would be residing outside the Deganga P.S. to the inspector in charge of Deganga P.S..
A comprehensive report be submitted before the ld. trial court on the next date so fixed. On the next date the appearance of the accused be ensured before the ld. trial court.
With the aforesaid observation, CRAN 1 of 2023 is disposed of.
The State would communicate this order to the officer in charge of Deyganga P.S.
