Heard learned counsels for the parties.

The petitioner alleges that the private respondent No.4 claiming to be an employee of the bank has defrauded him of an amount of Rs.12 lakhs. The petitioner lodged a complaint before the jurisdictional PS as well as Superintendent of Police, Purba Bardhaman, but to no effect.

Placing reliance on the authority in Aleque Padamsee vs. Union of India reported in (2007) 6 SCC 171 and Sakiri Basu Vs. State of UP & Ors. reported in AIR 2008 SC 907 learned counsels for the State and the Bank submit that the petitioner should take proper recourse under Section 175(3) of the BNSS in the event his compliant has not been taken care of by the PS.

The petitioner seeks liberty to take necessary steps before the appropriate forum for redressal of his grievance. Such liberty is granted.

The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
