Mr. Biswarup Chatterjee, Ms. Sangita Banerjee ...for the petitioner This is an application wherein petitioner has prayed for expeditious disposal of G.R. Case No. 477 of 2021, presently pending before learned Additional Chief Judicial Magistrate, Kharagpur. It is submitted on behalf of the petitioner that in the instant case FIR was lodged on 28.05.2021 and thereafter charge-sheet was submitted against the accused person on 27th August, 2021. Learned Court below took cognizance on 17.02.2022 and thereafter the Trial Court is fixing dates for SR and appearance without making charge hearing as the accused persons rotationally keeping themselves absent on each and every date.

He further submits due to deliberate absence of the accused persons, the Trial of the instant proceeding could not be proceeded. In such circumstances, he prayed for a direction upon the Court below for expeditious disposal of the aforesaid G.R. case being No.477 of 2021. Having herd learned Counsel for the petitioner it appears that the prayer made by the petitioner is innocuous and if a direction is passed in terms of the order made by the petitioner, the opposite party will have no cause to prejudice and, as such, service of copy of application upon the opposite party is dispensed with.

On perusal of the certified copy of the order-sheet it appears that since 05.03.2022 the Court is mechanically fixing date one after another and, as such, I find that this is an appropriate case where direction for expeditious disposal is required to be passed invoking this Court's jurisdiction under Section 529 of the BNSS.

Having considered so, the instant application being CRR 4537 of 2025 is hereby disposed of with a direction upon the Court below to make every endeavour for expeditious disposal of the aforesaid G.R. Case being No.477 of 2021 and, if required, he will split up the case record in respect of the absconding accused persons and will make charge hearing preferably within a period of 60 days from the date of communication of the order.
