Petitioner is aggrieved by the fact that he is apprehensive that his relations being the private respondents would throw him and his family away from the residence. To that effect, petitioner has communicated on several occasions with the Nadial Police Station. However, the said Police Station till date has not acted upon. Petitioner complains that his property has been ransacked which includes removal of money, CCTV camera, ornaments and other essentials.

Learned advocate for the State as well as the respondent nos. 4 to 7 is present.

Learned advocate for the private respondents opposes the contentions and denies each and every allegation which has been raised on behalf of the petitioner.

I have considered the contentions advanced by the learned advocate appearing for the petitioner which stems out of a family feud. If there is any cognizable offence made out, petitioner in the present circumstance would approach the jurisdictional criminal court by way of invoking the provisions of Section 175/223 of the BNSS as several complaints have already been filed before the jurisdictional police station. The concerned criminal court would assess regarding the veracity of the allegations and/or accusations and thereafter act strictly adhering to the provisions of law.

In the meantime, the police authorities would keep a strict vigil so that at the instance of any of the parties no breach of the peace or tranquility takes place at the locality.

With the aforesaid observations, WPA 24279 of 2024 is disposed of.

There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
