Petitioner is aggrieved because his vehicle has been taken away illegally by one of his relations. Learned advocate appearing for the state has submitted a report. Report reflects that petitioner could not satisfy the enquiry officer in respect of ownership of the vehicle.

Report so submitted be kept with the record.

Learned advocate appearing for the petitioner submits that he has purchased the vehicle and is in a position to produce the documents. In case the petitioner is able to show that he happens to be the owner of the vehicle and the vehicle is illegally retained by any other person including any relation, in that case he would approach the jurisdictional criminal court for invoking the provisions either

under section 175(3) or section 223 of the BNSS. Learned jurisdictional court will proceed in accordance with law and decide whether a case for investigation is made out or the case warrants issuance of process in respect of the proposed accused.

With the aforesaid observations WPA 24275 of 2024 is disposed of.
