Learned advocate appearing for the petitioner is aggrieved by the act and actions of the police officer.

Learned advocate for the private respondent submits that the respondent nos. 4 and 5 happens to be wife and the father-in-law of the petitioner. Report submitted by the state be kept with the record.

In view of the nature of accusations made by the petitioner and the present provisions of law incorporated under section 174(4) of BNSS, I direct that in case the petitioner is aggrieved by the act and actions of any public servant, in that case he would approach the appropriate jurisdictional court. The

jurisdictional court will consider the essence of the provisions newly incorporated and by adhering to the relevant sub-sections, act in accordance with law. Learned advocate for the state as well as the private respondents submit that since no affidavits have been called for, the allegations and/or accusations made in the writ petitions should be deemed to be denied and disputed.

In view of the aforesaid observations WPA 24270 of 2024 is disposed of.
