Mr. Banerjee, learned Additional Government Pleader has submitted a report.

Report reflects that the accused who was evading the process of law has been arrested on 29.12.2024.

The report also reflects that on 30.12.2024 a Test Identification Parade of the accused was conducted in presence of the learned Judicial Magistrate, 5th Court, Barrackpore where the defactocomplainant being the present petitioner identified the accused.

The records also reflect that the accused was granted 5 (Five) days police custody and thereafter his police custody was extended till 07.01.2025.

Having regard to the effective steps taken by the investigating agency, I direct the Investigating

Officer to unearth the truth by taking effective steps and take the investigation of the case to its logical conclusion. The Investigating Officer would protect the interest of the defacto-complainant who has set the law into motion.

Since the police authorities are at the helm and are in the midst of an investigation, at present, further pendency of the writ petition is unwarranted. Petitioner would be at liberty to take out appropriate application before the learned jurisdictional Magistrate if he is aggrieved by any action of the investigating agency.

With the aforesaid observations WPA 24244 of 2024 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
