Samir Kumar Das v. State Of West Bengal & ORS
S/L 90 31.01.2023 Court. No. 12 Suvayan WPA 25259 of 2017 Sri Samir Kumar Das Vs.
The State of West Bengal & Ors.
Mr. Debasish Das ...for the petitioner.
Mr. Manas Kundu Mr. subhendu Roy Chowdhury ...for the State.
Mr. Uttam Kr. Bhattacharya ...for the respondent no. 6.
All the parties to the instant writ petition are represented by their respective learned Advocates. The writ petition is now taken up for hearing. Heard learned Advocate for the writ petitioner, learned Advocate for the State and learned Advocate for the respondent No. 6.
On perusal of the entire materials as placed before this Court it appears that the present writ petitioner's name has been recommended for temporary appointment of valve operator "Sapai" water supply scheme by the Sabhapati, Contai - III, Panchayat Samiti in favour of the Savadhipati, Purba Medinipur Zilla parishad, District - Pruba Medinipur. It is argued that in spite of such recommendation the candidature of the present writ petitioner was not considered favourably by the respondents more specifically by the respondent No. 6. On perusal of the papers as annexed to the writ petition and as have been annexed with the objection as filed by the petitioner it does not appear to this Court that
neither any fundamental right nor any legal right of the present petitioner has been infringed on the part of any of the respondents. It further appears that the present writ petitioner could not place a single scrap of paper to substantiate that his name has been recommended as discussed (Supra) through a transparent selection process.
In view of such, this Court finds no merit in the instant writ petition and accordingly, the instant writ petition being WPA 25259 of 2017 is dismissed. Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
