Rakib (Allowed) CRM (M) 1825 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Krishnaganj Police Station Case No. 387 of 2023 dated 28.09.2023 under Sections 376(D)/506 of the Indian Penal Code and under Section 6 of the POCSO Act, 2012.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for two years one month and only five witnesses have been examined out of the proposed 21 witnesses.

Learned advocate for the State opposes the prayer for bail and submits that the petitioner along with others are directly connected with the offence and the statement of the victim girl reflects the heinousness of the offence also. Be that as it may, I have considered the materials appearing in the Case Diary including the medico legal examination report. Having regard to the period of detention and other attending materials, I am of the view that further detention of the petitioner is unwarranted. As such the prayer for bail of the petitioner is allowed.

Accordingly, petitioner namely, Sujoy Poddar shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court under POCSO Act, Krishnagar, Nadia.

If on bail, the petitioner shall be physically present on each and every date fixed by the learned trial Court. The petitioner shall not leave the jurisdiction of district of Nadia without the permission of learned Special Court. Accordingly, CRM (M) 1825 of 2025 is allowed. Case Diary be returned to the learned advocate appearing for the State.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
