The learned advocate appearing for the petitioner is aggrieved by the fact that the petitioner is in custody since November, 2022 and till date after submission of charge-sheet there has been no progress in the case as one of the accused person still absconding.
The records of learned Special Court reflects that the case is not progressing. The learned trial court would exhaust the process of law and complete such process within a period of two months on and from 4th December, 2023( which is the next date fixed before the learned Special Court). The learned trial court would thereafter fix date for consideration of charges and proceed with the trial of the case by fixing at list a schedule consisting of three dates and fixing such schedule once in every two months. No unnecessary adjournments should be granted to either of the parties and the Superintendent of Police of the concerned District would ensure regarding the execution of process both regarding to the availability
of any accused or any witness concerned. The Public Prosecutor in Charge of the case would produce the materials, documents and exhibits on the date so fixed. The learned trial court is directed to conclude the trial at the earliest.
With the aforesaid observations, the present revisional application being CRR 3795 of 2023 is disposed of. Pending applications, if any, are consequently disposed of. Certified copy of the order be kept on record. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
