Pursuant to an earlier order of this Court passed on 4th January, 2022 in WPA 17866 of 2021, the representation of the petitioners was considered by the Land Acquisition Collector, Purba Burdwan and by an order passed on 14th June, 2022, the authority requested the writ petitioners to contact the requiring body, i.e. the authority of the office of the Executive Engineer, Burdwan Division, Public Health Engineering Directorate for redressal of their grievance. Accordingly, the petitioners submitted a representation before the concerned authority on 26th July, 2022 which is yet to be considered. The petitioners seek a direction upon the concerned authority to consider the representation at the earliest.
It is submitted on behalf of the respondents that the 5th respondent be directed to consider the representation in accordance with law.
In view of the above, the writ petition is disposed of directing the 5th respondent to consider and dispose of the representation submitted by the petitioners dated 26th July, 2022 within one month from the date of communication of this order upon affording reasonable opportunity of hearing to all concerned including the petitioners, in accordance with law.
The decision taken by the authority shall be communicated to the petitioners within a week thereof. With the aforesaid observations and directions, the writ petition, being WPA 23526 of 2022 is disposed of. There shall be, however, no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
