1. Mr. Shiv Chandra Prasad, learned counsel for the appellant has placed a communication containing instructions dated 5th October, 2024 addressed by the RPFC, Regional Office, Kolkata. The same is taken on record.

2. It appears that four employees/respondents shall be released payment by the EPF authority. The quantum payable to each of the four respondents is indicated in the letter.

3. Mr. Prasad submits that payment shall be made either today or by tomorrow. This Court treats the same as an undertaking by the Regional Provident Fund Commissioner Mr. Krishna Shanker that payment as indicated in the said letter dated 5th October, 2024 shall be made positively by tomorrow.

4. In view of the above, FMA 994 of 2024 shall stand disposed of.

5. CAN 1 of 2023 shall also stand disposed of.

6. There shall be no order as to costs.

7. All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
