17/11/2025 D/L - 58 Court No.28 S. Kundu Rejected C.R.M.(A) 3561 of 2025 In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with STF (HQ) P.S. case no. 6 of 2025 dated 14.7.2025 under Sections 111(1)/111(3)/111(4)/111(7)/318(4)/319(2)/336(3)/338/ 340(1)/340(2)/61(2) of the BNS.

In the matter of: Sri Srikanta Halder

...Petitioner.

Mr. Mrityunjoy Chatterjee Mr. Shantanu Sinha ...for the petitioner.

Mr. Joydeep Roy Ms. Afreen Begum ...for the State.

1. Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner has been falsely implicated in this case. He was a casual employee of the Municipality and presently he is doing a business of contractor. He had his relatives' Aadhar Cards corrected by some of the other co-accused.

2. Learned counsel appearing for the State strongly opposes the prayer for anticipatory bail. He submits that the petitioner is a part of a racket involving Bangladeshi nationals as well, who used to prepare fake Aadhar Cards to create identities for people, even foreign nationals. Fingerprint scanner machine was seized from one of the principal accused. From him, mobile phone was seized with two Sim Cards. With this mobile phone, one of the

principal accused used to be in constant touch with the petitioner. Although the petitioner was working on a casual basis as a Driver in the Municipality, his bank statement would showed deposits of Rs.55 Lakhs (approximately) in different tranches over the last few months. The petitioner also has several criminal antecedents.

3. Considering the incriminating materials available in the case diary and the criminal antecedents of the petitioner, I do not consider this to be a fit case to grant anticipatory bail to the petitioner.

4. Accordingly, the application for anticipatory bail is rejected.

5. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
