Learned advocate also submits that the petitioner is in custody for nine months, as such, on any stringent condition, the petitioner may be released on bail.

Learned advocate for the State opposes the prayer for bail and submits that charges have been framed and witness action will commence from January, 2026. Having considered the quantum of seizure, I am of the view that the rigours of Section 37 of the NDPS Act is attracted, as such, custodial detention of the present petitioner is warranted.

Hence, the prayer for bail of the petitioner is Rejected.

However, the learned trial court is directed to fix a regular schedule so that within a reasonable period of time, trial can be taken to its logical conclusion. Accordingly, CRM (NDPS) of is dismissed.
