A report has been filed by the Executive Engineer (Civil)/Building, Borough-XII signed on 3rd January, 2024 wherein it has been mentioned that a joint inspection was conducted to ascertain the location and the premises of the unauthorized construction. After ascertaining the same, the Corporation issued notice under Section of the Kolkata Municipal Corporation Act, 1980 with intimation to the police. The case will now be processed under Section 400 of the Kolkata Municipal Corporation Act, 1980.

According to the Corporation the subject premises/plot number is the eastern side of the Plot No. EC-8, Rajdanga Main Road in Ward No. 107, BoroughXII. As unauthorized construction has been detected, the Executive Engineer (Civil)/Building, Borough-XII is directed to take prompt necessary steps in accordance

with law to deal with the same at the earliest, but positively within a period of twelve weeks from the date of communication of this order.

As proceeding for unauthorized construction will be initiated, the Officer-in-Charge of the Kasba Police Station is directed to keep strict vigil over the property to ensure that no further construction in any manner whatsoever is carried on at the subject premises and the private respondents are restrained from creating any third party rights at the subject premises. The writ petition stands disposed of.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
