1. It is submitted by Mr. Prasad that since after filing of the appeal the eligible respondents/writ petitioners have been allowed higher pension in terms of the order of the Single Bench. This was done pursuant to the decision of the Supreme Court in the case of EPFO & Anr. Vs. Sunil Kumar B. & Ors. reported in (2023) 12 SCC 701 particularly paragraph 46 thereof.

2. 25 other eligible persons are in the process of scheme for granting higher pension.

3. It appears that the claims of the petitioners, are being entertained by the EPFO in terms of the aforesaid decision of the Supreme Court in the case of EPFO & Anr. Vs. Sunil Kumar B. & Ors.

4. In view of the above, MAT 1916 of 2023 shall stand disposed of without any further order.

Consequently, connected application, if any, shall also stand disposed of.

5. There shall be no order as to costs.

6. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all formalities.
