The petitioner by dint of his representation dated 30th August, 2023, praying for condonation of the short-fall of the service period necessary for him to be eligible for grant of pension.

Learned advocate for the petitioner has referred to a judgment of this Court reported in 2013(3) CLJ Cal) 520. According to her, the petitioner would be eligible for condonation of such short-fall of the service period in case of grant of pension.

The respondent is represented.

Having considered the submissions and after perusing the materials available on records, the present writ petition is disposed of with the direction upon the respondent no.1, to consider petitioner's representation dated 6th April, 2023, in the light of the judgment as mentioned above. Let him decide about the same, within a period of four weeks from the date

of communication of copy of this order and pass a reasoned order if not the prayer of the petitioner is not allowed by him. Let the petition afford opportunity of hearing and consider the necessary documents, if necessary.

The writ petition is disposed of.

Since no affidavit is called for in this case, the allegations made in the writ petition, are deemed to have been denied by the respondents.

Urgent certified copy of this order, if applied for, shall be supplied to the parties, upon compliance of all necessary formalities.
